1. Definitions
"Coastward", "we", "us", or "our" refers to the property rental and advisory business operating under the Coastward name at the address above. "Service" refers to any of the rental, advisory, or caretaker services offered by Coastward. "Client", "you", or "your" refers to any person who engages with or uses our services. "Agreement" means these terms and any written service confirmation provided to you.
2. Acceptance of Terms
By contacting Coastward, using our website, or engaging any of our services, you confirm that you have read and agree to these terms. You must be at least 18 years of age to use our services. Acceptance constitutes a binding agreement between you and Coastward.
3. Service Description
Coastward provides three primary services on Koh Samui's Lamai coast:
- Lamai Coast Rentals — short-term furnished property rentals (one to twelve weeks)
- Island Home Advisory — consultative service for six-month or longer rental placements
- Caretaker Retainer — monthly property check-in and coordination service
Services are available primarily to clients renting property on the southern Koh Samui coast. Availability is subject to current capacity and property availability.
4. User Responsibilities
You agree to:
- Provide accurate and complete information when engaging our services
- Treat Coastward staff and associated landlords with respect
- Comply with all lease terms negotiated with property landlords
- Not use Coastward's services for any unlawful purpose
- Notify us promptly of any changes to your requirements or contact details
5. Rental Terms
Short-term rentals are subject to individual property terms as agreed between client and landlord, with Coastward acting as an intermediary. Rental prices are quoted in Thai Baht (฿). Utility arrangements vary by property and are disclosed prior to booking. Coastward does not act as a landlord and is not responsible for property maintenance beyond the scope of the Caretaker Retainer service.
6. Advisory Service Terms
The Island Home Advisory fee (฿20,000 one-time) covers the full consultative process from initial meeting through to lease signing and settling-in support. The fee is payable prior to commencement of the advisory process. If no suitable property is found within an agreed timeframe, a partial refund may be discussed at Coastward's discretion.
7. Caretaker Retainer Terms
The Caretaker Retainer (฿4,800/month) is payable monthly in advance. Either party may cancel with 14 days' written notice. Coastward will carry out property visits as described in the service summary provided at the time of engagement. We are not responsible for pre-existing property issues or issues that occur between scheduled visits.
8. Payment Terms
Fees are quoted and payable in Thai Baht (฿). Accepted payment methods will be confirmed at the time of service agreement. Payments for rental referrals, advisory, and retainer services are non-refundable once the relevant stage of service has commenced, except as described above.
9. Intellectual Property
All content on the Coastward website — including text, images, and design — is the property of Coastward. You may not reproduce or use any content without our written permission.
10. Disclaimers
Coastward acts as an intermediary and advisory service. We do not own the properties we list or recommend. We make reasonable efforts to ensure accuracy in property information but cannot warrant the completeness of information provided by landlords. Our advisory recommendations are offered in good faith based on available information and are not professional legal or financial advice.
11. Limitation of Liability
To the extent permitted by Thai law, Coastward's liability to you for any claim arising from our services is limited to the fee paid for the relevant service. We are not liable for indirect, consequential, or special damages arising from the use of our services or any property accessed through them.
12. Indemnification
You agree to indemnify Coastward against any claims, losses, or expenses arising from your breach of these terms or your use of a property obtained through our services.
13. Termination
Either party may terminate an ongoing service engagement with written notice. Coastward reserves the right to decline or discontinue service at its discretion. Termination of a caretaker retainer requires 14 days' written notice as noted above.
14. Governing Law and Dispute Resolution
These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these terms or our services should first be raised with us directly via legal@coastwesvs. We will aim to resolve disputes informally within 30 days. If unresolved, disputes shall be subject to the jurisdiction of the courts of Surat Thani Province, Thailand.
15. General Provisions
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. These terms constitute the entire agreement between you and Coastward in relation to our services. We may update these terms from time to time; continued use of our services following an update constitutes acceptance.
